1. General

1.1. These general terms and conditions of sale govern the sale of Tzuri Gueta brand jewelry on the website www.tzurigueta.com and shall take precedence over any terms of purchase unless otherwise formally and specifically provided in writing by us. Any purchase made on the website therefore implies the buyer’s unconditional acceptance of these general terms and conditions of sale.

1.2. These terms and conditions of sale are entered into by two parties: the Silka Design company (the brand Tzuri Gueta), a limited liability company (Société à Responsabilité Limitée) with a capital of €7,000 registered in the Paris Register of Companies under the number 490 221 751 RCS Paris, whose headquarters are located 1 avenue Daumesnil, 75012 Paris and whose VAT number is FR56490221751; and any natural person or legal entity, hereinafter referred to as “Customer,” who wishes to make a purchase on the website www.tzurigueta.com. 1.3. Every piece of Tzuri Gueta jewelry is hand made in our Paris workshop. Tzuri Gueta jewelry is made of silicone-fed lace using a patented technique combining openwork fabric and silicone. No molds or machines are used: each piece is unique and consequently, cannot be reproduced identically. The closures and other metal parts are made of 925 sterling silver, brass or stainless steel.

2. Price

2.1. The prices of the jewelry available for sale on the Tzuri Gueta online store in the wholesalers’ section are quoted in euros, taxes excluded. Shipping fees and VAT when applicable are communicated by email with the order confirmation.

2.2. Orders placed on the site and delivered outside of France may be subject to taxes and customs when the parcel reaches its destination. Any such taxes and customs duties that may potentially apply upon delivery of goods shall be paid by the Customer and are the responsibility thereof.

2.3. The Tzuri Gueta brand undertakes to apply the prices in force that are quoted at the time an order is placed.

3. Payment

3.1. Wholesale orders are paid by bank transfer before shipping. For new customers, a first deposit may be requested when the order is placed.

4. Orders

4.1. For every order placed on the site, a confirmation email shall be sent to the email address provided by the Customer, with the final amount including VAT when applicable as well as shipping fees.

4.2. The Customer shall also be notified via email when the order is shipped and shall be provided with the tracking number assigned to the parcel.

5. Lead times

5.1. Tzuri Gueta Paris jewelry is handmade and, as such, requires time to be created.

5.2. The time to produce the order depends on the quantity ordered and is communicated in the order confirmation email, the average being 4 weeks.

6. Shipping method

6.1. Orders are shipped via the French Post Office using the tracked parcel service, unless the wholesalers have their own DHL/Fedex/UPS account that they wish to use.

6.2. Shipping rates vary depending on the weight of the goods and the country of destination.

7. Force majeure

7.1. Silka Design shall not be held responsible for the complete or partial failure to fulfill its obligations under this contract, if this non-fulfillment is caused by an event that constitutes force majeure, including but not limited to cases of disruptions or strikes, whether total or partial, in particular of the postal services and means of transport and/or communication, floods, fires, and, in general, events beyond its control.

8. Guarantee

8.1. Tzuri Gueta brand products are handmade. Each piece is unique and, although we take the utmost care, pieces cannot be exactly reproduced identically. The jewelry you order may therefore differ slightly from the model shown on the website.

8.2. The products of the Tzuri Gueta brand apply to the legal guarantee of conformity and the legal guarantee against hidden defects. This warranty works for defects already present on the date of delivery and is valid for 24 months from the date of dispatch to the customer subject to normal use of the product.

8.3. Tzuri Gueta brand cannot be held responsible if the products are subjected to conditions that are incompatible with those set forth in the recommendations for use or to any other extreme situation such as variations in temperature, over-exposure to light, exposure to smoke and repeated immersions.

8.4. In the event of a defect, you may inform us by email at contact@silkadesign.com. The defective item must be sent back via the post office services to our workshop: 1 Avenue Daumesnil, 75012 Paris, France.

8.5. The evaluation of any manufacturing defect will be carried out at the discretion of the Silka Design workshop. Slight variations in size or color, for example, result from being hand crafted and cannot be considered as flaws. Similarly, the normal ageing of a product (fading of colors, alteration in the feel of the material to the touch) cannot constitute a condition for the exchange or return of the product.

8.6. Beyond the duration of the guarantee, a defective piece of jewelry may be repaired in the brand’s workshop. An estimate of the cost of repair shall be sent to the buyer within 72 hours of the defective item being dealt with.

9. Online Dispute Resolution for Customers

9.1. Silka Design is affiliated to the Trade Mediator Service of the UBH (Union de la Bijouterie Horlogerie) whose contact details are as follows: 22 avenue Franklin de Roosevelt 75008 Paris. This mediator is the CM2C, Center for Consumer Mediation of Justice Conciliators, which can be contacted at 14 rue Saint Jean 75017 Paris or via the website https://cm2c.net.

10. Personal information

10.1. In compliance with the French data protection law, the Tzuri Gueta online store will never pass on personal information about customers to third parties – unless they are acting in the purchase or shipment of your order (Paypal, mail service…).

11.2. The use, reproduction, exploitation or redistribution, even partial, of any element present on this website and online store, on any grounds whatsoever, is strictly prohibited.

12. Jurisdiction

12.1. In the event of a dispute, the applicable law is French law. The Tribunal de Commerce de Paris (Paris commercial court) has sole jurisdiction, even in the event of claims made in the course of litigation, claim for contribution from third party or multiple defendants.
